TopContentCreator ("we", "the Service") is operated by the operator of topcontentcreator.shop, a self-employed individual (autónomo) established in Spain, lck.msl@pm.me. By using the Service you accept these Terms.
TopContentCreator is a public pay-to-rank leaderboard. You pay to place and hold a position on a public ranking; your position is determined by the amount you pay. To take a position held by another user you must pay at least the stated minimum increment more ("outbidding"). It is an entertainment and self-promotion product and does not guarantee any audience, views, followers, income or result. A ranking position is the only thing you receive.
The Service is not affiliated with or endorsed by TikTok, Snapchat, Instagram, Facebook or any platform.
You must be at least 18 and legally able to contract.
You may submit a name/handle, link and/or image. You warrant you own it or have the rights to it, that it infringes no one's rights, and that it is your own profile or one you may represent. You grant us a worldwide, royalty-free licence to display it while shown.
No unlawful, deceptive, defamatory, obscene, sexual, hateful or harassing content, no impersonation, nothing sexualising or targeting minors, nothing infringing third-party rights. We may remove content and suspend access without refund for breach.
Payments are processed by Stripe. We never receive or store your full card number. All payments are final and non-refundable. The Service is supplied immediately and in full; at checkout you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service is fully performed (see §8). Being outbid, losing a position, dissatisfaction, or removal of unlawful content does not entitle you to a refund.
Under Article 103(a) of the Spanish consumer act (RDL 1/2007, TRLGDCU), the right of withdrawal does not apply to a service fully performed where performance began with the consumer's prior express consent and acknowledgement that the right is lost once fully performed. Because a position is delivered immediately at payment, and you give that consent at checkout, no withdrawal or refund is available once payment completes.
The Service is provided "as is". We may modify, suspend, reset or discontinue it, or change pricing, at any time.
To the maximum extent permitted by law we are not liable for indirect or consequential damages or lost profits. Our total liability for any claim is limited to what you paid us in the 3 months before the event.
